TERMS & CONDITIONS OF SALE The company means Turfworld limited, Pendeford Hall Farm, Pendeford Hall Lane, Wolverhampton, WV9 5BD TEL: 01902 784866 E MAIL: sales@turfworld.co.uk The Customer is anyone placing orders with The Company for the supply of goods or services from this website. Delivery method is Turfworld or any company or person employed or contracted by Turfworld to deliver goods. The company working days are: Mon – Friday only. Turf is sold only on the basis of the following points: ___________________________ Turf must be laid on the same day as it arrives, particularly in the summer or dry periods. Once laid it must be watered thoroughly and by that we do not mean a light sprinkle but saturated. This must be done each day thereafter particularly as the turf roots penetrate and attach to the ground. Any dispute regarding the quantity delivered or any damages to the products being delivered must be made at the time of delivery. Pictures can be sent to sales@turfworld.co.uk and any information about quantity. Colour of turf and other products may vary slightly during the year from those shown on this website. This is not a valid reason for cancellation or rejection of the delivered products. The sizes of the products listed on this website are approximate. Customers or the persons or person contracted by the customer to lay the turf must inspect the turf as it is laid. If any turf is unsatisfactory then it must be rejected before laying takes place. The Company does not accept any claims made for any additional laying costs or the disposal of the rejected turf. In the unlikely event that any unsatisfactory Turf is identified then it must be reported to the Company immediately preferably with photographs. Once delivered the Company accepts no liability for loss or damage to the products whatever the circumstances. Over the past few years certain pesticides, which have been used in the past during the growing of Turf, are no longer available for use in the process. Leather Jackets found in turf are not a reason for rejection or replacement.
SPECIFIC CONDITIONS FOR THE DELIVERY OF TURF We strongly recommend that someone is available at the point of delivery to accept delivery of any products. Any shortage or damage will not be considered after delivery has been made. Any damage or shortages must be noted on the delivery not before signing it and we also advise that the Customer contact the Company immediately or as soon as possible. Sometimes owing to conditions out of the Company’s control it might not be possible to deliver on the agreed date. In such cases every effort will be made to keep to agreed delivery dates but on the few occasions when it is not possible to deliver on the agreed date, then the company accept no liability for any loss or damages caused as a result of the delayed delivery. If a delivery is attempted but access to the point of delivery is not available then the delivery will be abandoned and the customer will be responsible for the cost of a second delivery. If, during this time the Turf deteriorates, then it is at the expense of the customer, NOT the Company if the Turf needs replacing. If in doubt about the method of delivery of any product or there are any restrictions about the delivery point (maybe school drop off or collection congestion) then go to the delivery section of this website or call us on 01902 784866 or e mail us on sales@turfworld.co.uk and explain your concerns and we will be happy to help you where we can. Delivery: Delivery by a contractor working on behalf of the Company will remove the product or products from the vehicle using a tail lift and a manual pump truck.. As described in our delivery section on this website, the ground must be flat and firm and accessible and safe. If a driver is unable to make the delivery because of any of the reasons given (the list is not exhaustive) then the goods will remain on the delivery vehicle and taken away. The Customer will then be responsible for a second delivery charge and if during this time the Turf has deteriorated beyond repair then the Company accepts no liability for the replacement costs or any other costs. There may also be a charge for the goods to be returned to the Company which the Customer must pay.
We strongly advise that someone is available to accept the delivery of the goods. DELIVERY IS KERBSIDE ONLY. If the Customer makes a request at the time of delivery that the goods be taken onto the delivery address property, then it is totally at the risk of the customer. The company does not accept any liability for damage to property during the delivery process. OTHER PRODUCT DELIVERIES All of the areas covered in the Turf specific terms & delivery conditions are the same for any product ordered from this website except that Turf is a perishable product and so has a very small timeframe to rectify any problems before the Turf has deteriorated beyond repair. In all cases it is the responsibility of the Customer to inform the Company of any specific information which might affect the delivery of the goods. Delivery will be made on an LGV (large goods vehicle) lorry. Information such as school traffic, low bridges, narrow lanes or roads or time restrictions (this list is not exhaustive) must be made clear before placing an order. If you place an order on this website and (during office hours) we note your comments of delivery restrictions, then we reserve the right to cancel your order or ask for additional charges to be met. If this cannot be agreed then a refund will be given before the order is processed. If this is done then no liability will be accepted for any losses as a result. Deliveries which are requested AM or Saturday Morning and arrive late will be refunded for only the additional charge paid and not the entire delivery charge. If a delivery is made late then the time of delivery must be clearly written on the delivery note with a signature. Failure to do so will result in a refund being refused for the additional delivery charge made. This is why we strongly advise that someone is available in person to accept the delivery.
NOTE: By signing for the goods you are signing to say you accept that the goods have arrived in full and in good condition. Once signed the company will not accept any request for replacement or refunds. Cancellation/Returns policy The customer does not have the right to cancel any order for goods which are likely to deteriorate or expire rapidly (such as Turf). This does not affect your statutory rights. All other products can be cancelled in writing to sales@turfworld.co.uk or by writing to Turfworld Ltd, Pendeford Hall Farm, Pendeford Hall Lane, Wolverhampton, WV9 5BD. An explanation of why you wish to cancel the contract is required. All cancellations must be made within 14 days of the delivery date. Any cancelled goods must be returned at the customers expense to Turfworld Ltd, Pendeford Hall Farm, Pendeford Hall Lane, Pendeford, Wolverhampton, WV9 5BD within 14 days of the letter of cancellation. For any goods, which are not perishable, that have already been despatched, the customer will be responsible for a charge to return the goods back to the Company’s address.
